Returns & Refunds Policy

1. Introduction

This Returns & Refunds Policy describes the three separate return and refund rights you have when you buy women’s shirts from ROSTTYA LTD (“ROSTTYA”, “we”, “us”, “our”). ROSTTYA LTD is a company registered in England and Wales, Company Number 16632288, with its registered office at 5c Forster Road, London, N17 6QD, United Kingdom. The sole director of ROSTTYA LTD is Rostislav Dimitrov Rusinov.

Three different return rights apply to your purchase. They are independent of each other and you may rely on whichever is most favourable in your circumstances:

1a. 14-Day Statutory Cooling-Off (Consumer Contracts Regulations 2013)

You have a statutory right to cancel your contract for any reason within 14 calendar days starting on the day after you (or your nominee, other than the courier) receive the Goods. This right exists by operation of law under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 (“CCR 2013”) and cannot be waived.

If you cancel under CCR 2013, you are entitled to a refund of the full price of the Goods plus the standard outbound delivery charge you paid (if any). Return shipping is paid by you; we estimate this at approximately £4.95 for UK domestic returns.

1b. 30-Day Commercial Return Window (Our Voluntary Policy)

In addition to the 14-day CCR 2013 right, we voluntarily offer a 30-day commercial return window for change-of-mind returns. The 30 days begin on the day you receive the Goods. This is our brand commitment, not a statutory entitlement, and it sits on top of (not in place of) the 14-day right above.

Under our commercial return window, the price of the Goods is refunded if returned in resalable condition. The original outbound delivery charge is not refunded for returns made between days 15 and 30 (this distinguishes our commercial extension from the statutory CCR 2013 right, which does include outbound shipping). Return shipping under the commercial window is paid by you.

1c. Faulty or Misdescribed Goods (Consumer Rights Act 2015)

If the Goods are faulty, not of satisfactory quality, not fit for purpose or not as described, you have rights under the Consumer Rights Act 2015 (“CRA 2015”) that are separate from both the 14-day CCR 2013 right and our 30-day commercial window:

  • Short-term right to reject: within 30 days of delivery you may reject Faulty Goods and receive a full refund of the price of the Goods plus all delivery charges paid.
  • Right to repair or replacement: within 6 months of delivery you may require us to repair or replace Faulty Goods at our cost. If we cannot do so within a reasonable time and without significant inconvenience to you, you may exercise the final right to reject.
  • Final right to reject: if one repair or replacement attempt fails, you are entitled to reject the Goods and receive a refund. A deduction for use may be made for goods retained more than 6 months.

For Faulty Goods, we cover the cost of return shipping in full and refund all delivery charges paid.

2. How to Start a Return

To start any return, email hello@rosttya.com with the following:

  • Your order number (visible in your order confirmation email)
  • The item(s) you wish to return
  • The reason for return (so we know whether it is a CCR cancellation, a 30-day change-of-mind return, or a Faulty Goods claim)
  • For Faulty Goods: photographs clearly showing the defect

We aim to respond within 1 working day with return instructions, including the return address (5c Forster Road, London, N17 6QD) and any return label if applicable.

3. Condition of Returned Goods

For both 14-day CCR cancellations and 30-day commercial change-of-mind returns, the Goods must be returned in resalable condition:

  • Unworn (other than for the purpose of trying the item on, as you would in a shop fitting room)
  • With all original tags attached
  • In or with the original packaging where reasonably possible
  • Free from any visible damage, marks, fragrance, deodorant or animal hair

For Faulty Goods this clause does not apply — items are returned in the condition the defect was identified.

4. Return Shipping Costs

The party responsible for return shipping depends on which right you are exercising:

  • 14-day CCR cancellation: You pay return shipping (approximately £4.95 for UK domestic). We refund the full price of the Goods plus the original outbound delivery charge.
  • 30-day commercial change-of-mind: You pay return shipping (approximately £4.95 for UK domestic). We refund only the price of the Goods; original outbound delivery is not refunded for returns made between days 15 and 30.
  • Faulty Goods (CRA 2015): We pay the return shipping in full. Provide the receipt and we will refund the return shipping cost, or contact us first and we will email you a prepaid return label.
  • Wrong item sent by us: We pay the return shipping in full and arrange a replacement or refund at your option.
  • Exchange for a different size of the same shirt: If you return an item under our 30-day commercial window and exchange it for the same shirt in a different size, we refund your return shipping as a goodwill gesture to support correct sizing.

5. Refund Processing

Method: Refunds are processed to the original payment method used at checkout. We cannot refund to a different card or to a different person.

Timing: Refunds are issued within 14 calendar days of receiving the returned Goods, or within 14 days of receiving evidence that you have returned them, whichever is earlier. This 14-day refund window applies to all three return rights and reflects our obligations under both CCR 2013 and CRA 2015. In practice we aim to process refunds within 3 working days of receipt; bank or card processing times may add a further 5 to 10 working days before funds appear in your account.

What we refund:

  • 14-day CCR cancellation: Full price of Goods + original outbound delivery charge
  • 30-day commercial return (days 15-30): Price of Goods only
  • Faulty Goods: Full price of Goods + all delivery charges + return shipping

6. Returns That Arrive Damaged or Not in Resalable Condition

If a returned item arrives in a condition that does not meet the criteria in clause 3, we will contact you, send photographs and explain the issue. We may at our discretion either: (a) offer a partial refund reflecting the diminished value, in line with CCR 2013 which expressly permits this; or (b) return the item to you at your cost.

This deduction will be fair and proportionate and we will explain how it was calculated.

7. Items Excluded from Change-of-Mind Returns

The following items are excluded from the 14-day CCR cancellation right and our 30-day commercial change-of-mind window for reasons of hygiene or because they have been personalised:

  • Items that are sealed for hygiene reasons (where the seal has been broken)
  • Items that have been altered, customised or made to your specification

These exclusions do not apply to Faulty Goods rights under CRA 2015 — those rights apply regardless of category.

At launch ROSTTYA sells only shirts and does not currently offer personalised or hygiene-sealed product categories, but this clause is included for completeness as the catalogue grows.

8. Sale Items

Items purchased at a reduced or promotional price are subject to the same return rights as full-price items, unless the item was explicitly marked “Final Sale — no returns” at the time of purchase. We will not retrospectively designate items as final sale.

9. International Returns

At launch we ship within the United Kingdom only. International shipping and international returns are not currently available. This will be reviewed in future Sprint phases.

10. Disputes

If you have a complaint about a return or a refund decision, please email hello@rosttya.com and we will respond within 5 working days. If we cannot reach agreement, you have the right to refer the dispute to an Alternative Dispute Resolution body or to the courts of England and Wales.
