Terms of Sale

1. Introduction

These Terms of Sale (the “Terms”) govern all sales of goods through the website at rosttya.com (the “Website”) and the corresponding contract between you (the “Customer”) and ROSTTYA LTD (“ROSTTYA”, “we”, “us”, “our”).

ROSTTYA LTD is a company registered in England and Wales, Company Number 16632288, with its registered office at 5c Forster Road, London, N17 6QD, United Kingdom. The sole director of ROSTTYA LTD is Rostislav Dimitrov Rusinov. The trading name and brand is “ROSTTYA”.

By placing an order through the Website you agree to be bound by these Terms. Please read them carefully before placing an order.

2. Definitions

“Customer” means the person placing an Order through the Website.

“Order” means an offer by the Customer to purchase Goods through the Website, submitted via the checkout.

“Goods” means the women’s shirts and related apparel items offered for sale on the Website.

“Distance Contract” means a contract concluded between us and the Customer under an organised distance sales scheme, as defined under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 (“CCR 2013”).

“Returns Period” means the 30-day commercial return window we offer in addition to the statutory 14-day cooling-off period.

“Faulty Goods” means Goods that do not conform to the contract under the Consumer Rights Act 2015 (“CRA 2015”), including goods that are not of satisfactory quality, not fit for purpose, or not as described.

3. About the Contract

The contract between you and ROSTTYA is a Distance Selling Contract under CCR 2013. The contract becomes binding when we send you an order confirmation email after your Order is accepted and your payment has been authorised.

We reserve the right to refuse any Order at our discretion, for example if Goods are out of stock, if the price has been misstated due to a pricing error, or if we suspect fraudulent activity. If we refuse an Order, we will not charge your payment method or will refund any amount already taken in full.

4. Placing an Order

To place an Order you must add Goods to your basket, proceed to checkout, provide delivery and billing details, select a payment method and confirm your Order. Before submitting you will have the opportunity to review and correct the details of your Order.

Following submission, you will receive an automated acknowledgement email. This is not yet an acceptance of your Order. We will send you a separate order confirmation email once we have accepted the Order and processed your payment. The contract is formed at the moment of order confirmation.

5. Prices

All prices on the Website are in pounds sterling (GBP) and include all applicable taxes. Prices for shirts on the Website typically range from £50 to £150 per item.

Prices may be changed from time to time but the price applicable to your Order is the price displayed at the moment you place the Order.

If a pricing error is identified after an Order is placed but before dispatch, we will contact you, explain the error and either invite you to confirm the Order at the correct price or cancel the Order and provide a full refund.

6. Payment and Delivery Charges

Payment is taken at the time of Order via Stripe, Apple Pay or Google Pay. All payments are processed securely; we do not store full card details on our servers.

Standard UK delivery is free on orders of £75 or more. For Orders below £75, a flat-rate delivery charge of £4.95 applies and is shown at checkout before you submit your Order.

If payment cannot be taken, we will contact you to arrange an alternative payment method. If alternative payment is not provided within 3 working days, the Order will be cancelled.

7. Delivery

We dispatch from our UK fulfilment location within 2 working days of order confirmation. Standard delivery is by Royal Mail Tracked 48, with typical delivery of 2 to 5 working days from dispatch. An optional DPD upgrade is offered at checkout for faster service.

Risk in the Goods passes to you on delivery to the address you provided. Title in the Goods passes once we have received full payment.

8. Right to Cancel (14-day Statutory Cooling-Off)

Under CCR 2013 you have a statutory right to cancel a Distance Contract for any reason within 14 calendar days starting on the day after you (or a person nominated by you, other than the courier) receive the Goods. This right is in addition to, and separate from, our 30-day commercial Returns Period (see clause 9) and your rights in respect of Faulty Goods (see clause 10).

To exercise the right to cancel under CCR 2013, please email hello@rosttya.com with your order number before the 14-day period ends. You may use the cancellation form set out in Schedule 3 of CCR 2013 but you are not required to do so.

If you cancel under CCR 2013 we will refund the price of the Goods and the standard outbound delivery charge you paid (if any). We may deduct from the refund an amount equal to any diminished value of the Goods caused by handling beyond what was necessary to examine them. We will issue the refund within 14 days of receiving the Goods back from you, or within 14 days of receiving evidence that you have returned them, whichever is earlier.

9. 30-Day Commercial Returns (Change of Mind)

In addition to your statutory rights under CCR 2013, we voluntarily offer a 30-day commercial Returns Period for change-of-mind returns. The 30 days begin on the day you receive the Goods.

For change-of-mind returns under our commercial Returns Period (whether within the first 14 days under CCR 2013 or within days 15 to 30 of our commercial extension), the cost of return shipping is paid by you, the Customer. We estimate this at approximately £4.95 for UK domestic returns, but the exact amount depends on the carrier and service you select.

Returns made between days 15 and 30 under our commercial extension are not refunded for outbound shipping charges; only the price of the Goods is refunded. Returns made within the first 14 days under CCR 2013 are refunded in full for both Goods and standard outbound shipping.

10. Faulty or Misdescribed Goods (Consumer Rights Act 2015)

Your rights in relation to Faulty Goods are separate from the 14-day CCR right and the 30-day commercial Returns Period. They include:

  • Short-term right to reject: within 30 days of delivery you may reject Faulty Goods and receive a full refund.
  • Right to repair or replacement: within 6 months of delivery you may require us to repair or replace Faulty Goods at our cost.
  • Final right to reject: if one repair or replacement attempt fails, you may reject the Goods and receive a refund.

For Faulty Goods, we cover the cost of return shipping in full. Please email hello@rosttya.com with photographs of the defect and your order number, and we will arrange a return label or reimbursement.

11. Size and Fit

Every product listing on the Website includes the model’s height and the size worn in the photographs, plus actual garment measurements (chest, length, sleeve) in centimetres. A complete Size Guide & Fit page sets out UK / EU / US size conversions and guidance on how to measure yourself.

Ordering an incorrect size is treated as a change-of-mind return under clause 9 (the Customer pays return shipping). If you exchange the returned item for the same shirt in a different size, we will refund your return shipping cost to encourage correct sizing.

12. Material Composition and Care

The material composition, country of manufacture and care instructions for each shirt are disclosed on the product page and on the care label of the garment itself. Garments are designed in London and manufactured at our partner workshops; further detail is set out on our Sustainability & Sourcing page.

13. Liability

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for any breach of statutory rights under CRA 2015, or for any other liability that cannot be limited or excluded by law.

Subject to the paragraph above, our total liability to you in respect of any Order is limited to the price you paid for the Goods in that Order. We are not liable for indirect or consequential loss, or for loss that was not reasonably foreseeable when the contract was formed.

14. Intellectual Property

All designs, brand names, logos, photographs and content on the Website are the intellectual property of ROSTTYA LTD or its licensors. You may not reproduce, copy or commercially use any such content without our prior written consent.

If you share photographs of yourself wearing our Goods on social media and tag ROSTTYA, you grant us a non-exclusive licence to repost that content on our own social channels with attribution. You may revoke this licence at any time by emailing hello@rosttya.com.

15. Personal Data

We process your personal data in accordance with our Privacy Policy, which sets out the data we collect, the lawful basis for processing, how long we retain it and your rights under UK GDPR.

16. Complaints and Dispute Resolution

If you have a complaint about your Order or any Goods, please email hello@rosttya.com and we will respond within 5 working days. We aim to resolve all complaints fairly and promptly.

If you are not satisfied with our final response, you have the right to refer the dispute to an Alternative Dispute Resolution body or to the courts of England and Wales. The European Commission’s Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr remains available for UK consumers in respect of disputes with UK-based traders, although the UK is no longer a member of the EU ODR scheme since 1 January 2021.

17. Force Majeure

Neither party is liable for failure to perform obligations under these Terms where the failure is caused by an event outside reasonable control, including (without limitation) acts of God, fire, flood, severe weather, civil unrest, war, pandemic, courier strike or government order. Where such an event affects dispatch or delivery, we will notify you and either extend the delivery window or, if the delay is material, offer you a full refund.

19. Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction over any dispute arising from these Terms, save that consumers resident in Scotland or Northern Ireland may bring claims in their local courts.

20. Changes to These Terms

We may update these Terms from time to time. The version applicable to your Order is the version in effect at the moment you place the Order. We will post any updated version on this page with a revised “Last updated” date.
